Community Imprints is referred to in this document as “CI”. CI is a commercial enterprise registered in the state of Victoria, Australia. CI owns and runs a website with two URLs: http://communityimprints.com and http://communityimprints.com.au. CI produces, publishes, and sells information products and artistic works for profit.

As a commercial enterprise CI has certain terms of service and sale that relate to site use, product sales, the provision of services, the use of information collected from consumers and the limits of CI’s liability and responsibility. These terms and conditions are outlined below. Please read them carefully before making use of the CI website, products and services.

By using CI’s website you agree to the site’s Terms of Service and Terms of Sale, which are outlined in this document and subject to change without notice.

You agree that the law applying is the law in the state of Victoria Australia and you submit to that State’s jurisdiction in relation to any dispute.

1. Terms of Service

General site use issues

The intellectual property in the CI website is owned, operated, licensed and controlled by CI and covers the website’s design and content.

You agree not to interfere in the structure or running of the website.

You agree that CI will not be held responsible for any destructive computer code inadvertently transmitted nor for any of your information being obtained by hackers. You will not hold CI liable for any resultant losses or damages to yourself or any third party.

You are permitted to create electronic links to the CI website so long as the originating site is not engaged in illegal activity, does not portray CI in a negative light nor present false, defamatory or misleading information about CI. CI asks that you let us know when you link to our site.

Respecting our visitors and customers

CI was founded with the aim of offering high quality social resources to people facing crisis and change.

CI seeks to promote social diversity so its products necessarily represent diverse views and values. We publish and sell our products in the sincere belief that they are potentially useful to visitors and customers. While CI can not guarantee the usefulness or accuracy of any of its products, we undertake to respond courteously to any queries or complaints.

Content is not provided as advice

The content provided on the site and via CI’s products is not provided as advice, but as general information and personal opinion. You should use common sense in determining the value, relevance, and validity of all content. Expert advice should be sought before making decisions based on such content.

You need to be aware that the views and opinions contained within CI’s products are not necessarily the views and opinions of CI itself.

Privacy

CI does not on-sell your personal details.

CI does collect information from its customers and users throughout its website for commercial purposes and makes use of that information both to make offers to you and to design products or services that could be of use to you.

CI will collect your email address when you make email contact with us. We reserve the right to contact you during promotions or as part of our marketing activities, and our research and development efforts.

CI may share your information with law enforcement agencies at our discretion.

CI may use cookies to collect information for commercial purposes.

Respecting our artists and content creators

CI seeks to find a balance between disseminating useful products at little or no cost and promoting and protecting the property and moral rights of its artists and content creators. CI has developed a number of different types of content in an effort to find this balance:

Type 1: Free to reproduce with acknowledgment

CI publishes a number of products that are free to reproduce with acknowledgment. This literally means that you can reproduce and distribute these products without paying CI provided neither the text nor the images are altered in any way and provided the product’s acknowledgement statement is reproduced unaltered in content, position, font size, and logo size. This ‘free to reproduce with acknowledgement’ licence extends to reproduction and distribution in third party, commercial products. If a ‘free to reproduce with acknowledgement’ product is reproduced and distributed, but the text, images or acknowledgement, including the CI logo, has been altered or omitted, CI reserves the right to take legal action for breach of intellectual property rights.

If you wish to adapt a ‘free to reproduce with acknowledgement’ you must submit the request to CI in writing.

Type 2: Sold or given away with a licence to distribute to a limited number of third parties  
 
CI publishes products, which can be distributed to a limited number of third parties. These products have an accompanying warning to third parties not to further distribute the product. This warning must not be removed from such a product. If this type of product is distributed beyond the limited licence, CI reserves the right to take legal action for breach of intellectual property rights.

Type 3 All other material and products

1 Images published on the CI site

CI publishes images of works of art and photographs. Unless an artwork or photograph is specifically identified as being ‘free to reproduce with acknowledgement’ you do not have the right to download it to your computer or print it unless you have paid for that right and you do not have the right to distribute it unless you have written permission to do so or it is ‘sold or given away with a licence to distribute to a limited number of third parties’. If an artwork is ‘sold or given away with a licence to distribute to a limited number of third parties’ you do not have the right to distribute it beyond the terms of that licence.

CI promotes the welfare of artists and photographers, by generating income for them through the sale of downloadable image files, hardcopy fine art prints and originals. By respecting the property rights of the artists and photographers contributing to CI, you are actively helping to enliven the visual arts and to sustain the lives of individual artists, photographers, and their families.

2 Other copyright material published on the CI site

Unless a product or any other material on the CI site is specifically identified as being ‘free to reproduce with acknowledgement’ you do not have the right to download it to your computer or print it unless you have paid for that right and you do not have the right to distribute it unless you have written permission to do so or it is ‘sold or given away with a licence to distribute to a limited number of third parties’. If a product or any other material is ‘sold or given away with a licence to distribute to a limited number of third parties’ you do not have the right to distribute it beyond the terms of that licence.

CI promotes the welfare of content creators, by generating income for them through the sale of downloadable files and hardcopy products. By respecting the property rights of the content providers who contribute to CI, you are actively helping to enliven the arts and to sustain individual practitioners and their families.

Respecting the property rights of third parties

CI publishes and offers it products to the public in good faith and in the sincere belief that its products do not breach any third party intellectual property rights. CI invites any customers or visitors who suspect that such rights have been breached to provide us with sufficient detail of the suspected breach to allow us to investigate the concern. If we believe such a breach has occurred, we will withdraw the product from sale until the matter can be resolved.

Supervision of children and adolescents using the site

CI publishes social resources for people facing crisis and change. Much of the material on the site is not at all suitable for children. Children using the site should be supervised at all times and should not be permitted to browse the site or read, watch or listen to material that parents have not previously reviewed. Parents need to be aware that the site and its contents are dynamic and even previously reviewed material can be subject to change without notice.

Whether the material on the site is appropriate for individual adolescents is a matter for individual families to decide. As the site contains a diverse range of material relating to sensitive subject areas, parents should assess the site’s content against their own family’s values before allowing an adolescent to use the site without supervision. Parents should also be aware that the site and its content are dynamic and new material can be added without warning.

Publishing opportunities – no obligation to publish

CI sometimes invites visitors and customers to submit content and/or content proposals. These invitations do not constitute an obligation on CI’s part to publish or assess content or to enter into correspondence relating to any specific content and/or content proposal. In addition some publication opportunities on CI are provided as a community service and do not attract any remuneration.

Publishing opportunities – copyright in material submitted for publication

If you submit material to CI for publication consideration:
a) you will retain copyright in any unsolicited submissions; and
b) CI will clearly distinguish between an invitation to submit where you will retain copyright and an invitation to submit where CI assumes copyright in the material submitted and is free to reproduce and distribute that material without remunerating you.

Contributing to the CI site – copyright in on-site posts made by visitors and customers

When you post any remarks, suggestions or comments on the CI website, you grant CI the non-exclusive right to edit, adapt and publish that content for the term of copyright without remunerating you. You acknowledge that CI has this right regardless of whether it responds to the remarks, suggestions or comments you have submitted or notifies you of intended use.

Contributing to the CI site – general issues relating to on-site posts

You agree that you will not post any defamatory, libellous, sexist, racist, ageist or illegal material on the CI website and that you own, or have the rights to, the intellectual property in the material you post. You also agree that you will not identify any third parties in any material you post and that you are over 18 years old and capable of making this agreement.

You also agree that when posting material on the website, you will only post pertinent, non-commercial material. You agree not to post abusive or harassing material, not to advocate pyramid schemes, not to solicit for donations or funds, not submit material containing destructive computer code, not to impersonate others, not to attempt to defraud anyone. CI does not want any postings that compromise the integrity or the look and feel of the CI website.

You acknowledge that CI has the right to remove any posting without redress or explanation and that CI may refuse future postings from you or enterprises with which you are associated.

Copyright in emails to CI

You will retain copyright in your emails to CI. CI reserves the right to request your permission to reproduce the content of your emails for both commercial and non-commercial purposes without remunerating you.

2 Terms of Sale

Purchase

Upon receipt of your cleared payment for a product, CI will supply that product in the following manner:
a)    Hardcopy items will be posted within 3-4 business days and shipped in the manner advised at the time of purchase.
b)    Downloadable items will be available from the CI website in accordance with the instructions and timelines advised at the time of purchase.
If a product has been paid for but is found to be out of stock, you will be advised within 3-4 business days and offered a choice between a refund and an opportunity to place your order on hold if CI is intending to reorder stock.

No interest will be paid on money refunded when a product is out of stock.

Returns

CI will accept returns and requests for refunds on the following basis:

1    Hardcopy products

Provided the product is returned to CI at your expense and CI has received the product via its postal address at 33/114 Dodds Street, Southbank, Victoria, 3006, Australia, CI will refund the cost of the product and the initial postage.

2    Electronic products

Provided you have supplied CI with the product details and CI can verify your purchase, CI will refund the cost of the product.

If you are seeking a refund your will need to provide your banking details in a form acceptable to CI or be registered to accept payments via PayPal. Refunds will be processed within 45 days of receipt of a hardcopy return or confirmation of purchase in the case of electronic products.

CI appreciates any feedback in relation to dissatisfaction with its products, but you do not have to give a reason for your dissatisfaction in order to qualify for a refund.

CI reserves the right to refuse refunds to you if you make more than two consecutive requests for refunds.

No interest will be paid on refunded money.

Financial information

CI receives all of its credit card payments via PayPal. CI does not receive a copy of your credit card details and does not hold any of your personal financial information. For further information about PayPal you should visit http://www.paypal.com.au.

When purchasing from CI you undertake that you are the owner of the funds or credit card you are using to make any purchase and that you are over 18.
